Growing importance of drones in the airspace
Unmanned aerial systems have evolved from a niche phenomenon to a firm fixture in air traffic over recent years. Whether for inspections, surveying, media production, or security tasks – drones are now an indispensable part of many sectors.
However, with this development, the challenge of safely integrating unmanned aerial vehicle operations into existing airspace structures also grows. This is particularly critical in control zones around airports, where dense traffic, complex procedures, and high safety requirements all converge.
Legal framework with gaps
In principle, drones are legally considered aircraft and are therefore subject to the same air traffic regulations as manned aircraft. In practice, however, many of these regulations were not originally designed for unmanned systems.
At the European level, regulation is currently still in a transitional phase. Although uniform and comprehensive regulations are under development, they have not yet been fully implemented. Against this backdrop, national regulation provides an important interim solution, bringing clarity for operators and authorities.
Division of the control zone into two as a central element
A key point of the new principles is the division of the control zone into two areas with different requirements.
In the outer area of the control zone, up to a maximum height of 100 metres above ground or aerodrome level, drone flights are generally possible under certain conditions. Here, air traffic control can issue general authorisations, which simplify and standardise operations.
The situation is different in the inner area and at higher altitudes. There, an individual clearance from air traffic control is required for each individual flight. This can be restricted in terms of space and time so as not to impair the safe operation of manned air traffic.
Clear operating limits and minimum requirements
The regulation defines concrete framework conditions for drone operations in controlled airspace. This includes, among other things, a minimum requirement for visual line of sight, which must generally not be fallen below. At the same time, a maximum flight altitude is established, which clearly limits operations from below.
An important exception concerns flights in close proximity to obstacles. Here, drone operations are permitted in a narrowly defined area, for example, for inspection or maintenance work on structures.
Of note is also the express authorisation of flights beyond the direct visual line of sight of the pilot under certain conditions. This reflects the increasing technical development and opens up new possibilities for use, for example in industrial applications.
Autonomous systems still excluded
Despite the opening up to advanced operating methods, a central point remains clearly regulated: fully autonomous drone flights are still not permitted. Responsibility for control and monitoring always lies with the operator.
This responsibility is also emphasised during swarm flights. Although such operations are generally permitted, collision avoidance within the swarm must be ensured by the operator.
The role of air traffic control is clearly defined
A key aspect of the new regulation is the clear demarcation of responsibilities. Air traffic control does not carry out active separation between drones and manned traffic. Traffic information is also generally not passed on to drone pilots.
Instead, the responsibility for the safe operation of the flight lies with the operator of the unmanned system. Manned air traffic is merely informed generally about possible drone activities in the lower airspace.
This clear division of roles is intended to prevent the already complex traffic management in control zones from being further burdened.
Liability and responsibility
Another key point is the liability regulation. Operators of drones used within these principles must indemnify the competent authorities and air traffic control organisations from any potential damage.
This makes it clear that operating in sensitive airspace carries a high degree of personal responsibility. At the same time, this underscores the necessity of clarifying all relevant permits and insurance in advance.
Outlook: Transition to European Harmonisation
The new principles are explicitly designed as a transitional solution and will apply until the full implementation of corresponding European regulations. They can also be adapted or revoked at any time in order to respond to new developments.
In the long term, it is to be expected that the integration of drones into controlled airspace will continue to advance. Topics such as automated traffic management systems, digital clearance processes and new communication solutions will play a central role in this.
Conclusion: More clarity in a dynamic environment
With the new regulation, the Federal Ministry of Transport is creating an important framework for the safe operation of drones in controlled airspace. The clear structure, defined responsibilities, and practical guidelines offer a reliable foundation for both operators and authorities.
At the same time, it becomes clear that the integration of unmanned aerial vehicles into existing air traffic remains a complex process. The principles now introduced are an important step – but certainly not the last on the way to a fully integrated airspace.
